Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Bidvana, LLC, operating as Bidvana. They govern your use of www.bidvana.com, our online store, any Bidvana mobile application, and every order you place with us (together, the “Services”).

By using the Services, creating an account or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Bidvana buys customer returns and overstock in bulk from major retailers. Every unit is opened, inspected and photographed by hand at our warehouse, given a condition rating, and listed for sale individually. Some units also go through a functional bench inspection, and that report is published on the listing. Units that do not meet the standard for any rating are donated rather than resold.

You must be at least 18 years old, or the age of majority where you live, to create an account or place an order. By using the Services you represent that you meet that requirement, that the information you give us is accurate, and that you are not barred from receiving goods or services under applicable law.

Some features require an account. You agree to provide accurate information, to keep it current, and to keep your sign-in credentials confidential. You are responsible for activity that happens under your account.

Tell us promptly at support@bidvana.com if you suspect unauthorized use. We may suspend or close an account that we reasonably believe is being used fraudulently, abusively, or in breach of these Terms.

Our inventory is used, returned or overstock merchandise unless a listing says otherwise. There is normally exactly one of each item: once it sells, that listing is gone, and we cannot substitute an identical unit.

Each listing carries a condition rating, photographs of the actual unit and, where the item went through our bench, an inspection report. Taken together, those are our description of the item.

Our ratings are good-faith professional descriptions of the unit as we found it. They are not a warranty that an item is free of every defect, that packaging is original or complete beyond what we state, or that a used item will perform like a new one. Where an accessory, manual or original box is missing and we noticed, we say so; read the listing, the photos and the report before you buy.

Colors can vary between screens, and manufacturer specifications are the manufacturer’s, not ours.

Prices are shown in US dollars and exclude tax and any delivery or shipping charges, which are calculated at checkout.

Listing prices step down on a published schedule until the item sells. A price you saw earlier is not a price we owe you later, and a price that has dropped since your purchase does not entitle you to a refund of the difference. Because there is one of each item, the first buyer to complete checkout gets it; adding something to a cart or watchlist does not reserve it.

Despite our best efforts, a listing may occasionally contain an error in price, description or availability. We reserve the right to correct errors and to cancel an order affected by one, even after it was submitted. If we cancel for that reason and you have already been charged, we will refund you in full.

By submitting an order you authorize us and our payment processors to charge your payment method for the total shown, including tax and any delivery charge. Your payment is not captured until we confirm the order. That means we have verified the item is in hand and ready for you. Until then you may see an authorisation hold from your bank.

If we cannot confirm an order, we release the authorisation or refund the charge and tell you why. You are responsible for any bank or card fees your issuer applies.

Each listing shows the fulfillment options available for that item. Depending on the item and your address, those may include:

• Same-day pickup when available, during posted pickup hours and with the identification we ask for.
• Local delivery to addresses near the warehouse, within the radius shown at checkout.
• Standard shipping through a major carrier such as UPS, FedEx, or USPS. Some items are too large, heavy or restricted to ship, and those listings will say so.

Delivery and pickup estimates are estimates, not guarantees, and can be affected by carriers and weather. Risk of loss and title pass to you when the item is handed to you at pickup or delivery, or when the carrier delivers it to the address you gave us. If an uncollected pickup order goes unclaimed past the window we tell you about, we may cancel it and refund the item price.

Our rating is a promise. If an item arrives in materially worse condition than we described, you choose the remedy: return it for a refund, or keep it and we adjust the price to make it right.

The one exception is items rated As-Is. Those are final sale by definition. The rating tells you the item is sold in the state described, and that trade-off is why the price is what it is. As-Is is labeled everywhere it appears, including at checkout.

To start a claim, email support@bidvana.com within the return window described in your order confirmation, tell us what does not match the description, and include photos. We may ask you to return the item in the condition you received it, with everything that came with it; we cover return shipping when we got the description wrong. Approved refunds go back to the original payment method.

Buyer’s remorse, such as changing your mind, finding that it does not fit your space, or finding it cheaper elsewhere, is not covered by this guarantee. We may still accept such a return at our discretion; ask.

You agree not to:

• Use the Services for any unlawful purpose, or to buy items you intend to use unlawfully.
• Scrape, crawl or otherwise harvest listings, prices or photographs by automated means, or attempt to circumvent rate limits or access controls.
• Interfere with the Services, probe them for vulnerabilities without our written permission, or attempt to gain access to accounts or systems that are not yours.
• Submit false information, use another person’s payment method without authority, or abuse our returns process.
• Resell, reproduce or republish our content, photographs or listings without permission.

The Services, including our text, photography, product descriptions, inspection reports, graphics, software and page design, are owned by Bidvana, LLCor our licensors and are protected by copyright and other laws. “Bidvana”, our logo and our marks are ours; you may not use them without our written permission.

We grant you a limited, personal, non-exclusive, revocable license to use the Services to browse and buy for your own use. Everything not expressly granted is reserved.

Third-party brand names and product images appear only to identify the goods we are selling. Those marks belong to their owners, and their use here does not imply any affiliation with, or endorsement by, those brands.

We stand behind the condition we describe. That is our condition guarantee, and nothing here limits it. Beyond that description, and to the fullest extent permitted by law, items are sold as-is and as-available, and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Used and returned goods may show wear consistent with their rating. Manufacturer warranties on returned or overstock merchandise are frequently void, expired or non-transferable, and we make no representation that any manufacturer warranty applies to what you buy from us.

The Services themselves are provided as-is. We do not warrant that they will be uninterrupted, error-free or secure.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded.

To the fullest extent permitted by law, neither Bidvana, LLC nor its owners, employees or suppliers will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or loss of goodwill, arising out of or relating to the Services or any item you buy from us, even if we were advised such damages were possible.

Our total liability for any claim relating to an item is capped at the amount you actually paid us for that item. For claims not relating to a specific item, our total liability is capped at the greater of the amount you paid us in the six months before the claim arose, or $100.

Some jurisdictions do not allow these limitations, in which case they apply only to the extent permitted.

You agree to indemnify and hold harmless Bidvana, LLCand its owners and employees from any claim, loss, liability or expense (including reasonable legal fees) arising out of your misuse of the Services, your breach of these Terms, your violation of any law, or your infringement of anyone’s rights.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You and Bidvana agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of those courts. Nothing here prevents either party from bringing a qualifying claim in small-claims court.

We may update these Terms as the business changes. When we do, we revise the effective date at the top of this page and, where the change is significant, give notice through the Services or by email. Changes apply going forward. The version in effect when you placed an order governs that order. Continuing to use the Services after an update means you accept the revised Terms.

If any provision of these Terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and any terms shown at checkout, are the entire agreement between you and us about the Services.
